To Our Beloved Gaming Community & Friends,

Monday, Nov. 5, 2012, will be remembered as a day of infamy and shame for the gaming industry with XPlay initiating a disgraceful harassment action against DataBlitz for alleged selling of "unauthorized" stocks of NBA 2K13.

Yesterday, XPlay released an official statement listing down various details of meetings between XPlay and DataBlitz in the weeks leading to the launch of NBA 2K13. In spite of all that's been said in their press release, they've conveniently omitted the most pertinent details:

1. All the meetings that took place between Xplay and DataBlitz were initiated at the request of XPlay. DataBlitz has never asked to meet with XPlay and were only asked to participate in meetings and/or to join XPlay's so-called "marketing programs" (which are really nothing more than just glamorized parlor game events). DataBlitz participated in the meetings and "marketing programs" out of courtesy to XPlay and no such thing as "primary partnership", whatsoever was ever discussed, offered, nor penned on paper, whatsoever.

2. Apart from just saying that they will be distributing NBA 2K13, XPlay has never indicated in any form of writing or communications whatsoever to DataBlitz that they are the exclusive distributor of the game.

3. Thirdly, and this is the most important and glaring omission in XPlay's press release: in spite of the above, the fact is that DataBlitz still went ahead and purchased a considerable quantity of NBA 2K13 stocks from XPlay as a gesture of goodwill towards XPlay, even knowing that they are still very new to the industry of console games, without any proven track record whatsoever to speak of along this front.

However, it is the understanding of DataBlitz that XPlay is just another reseller of the game, and as we still live in a free country the last time we checked, DataBlitz reserves its right to buy stocks of the game from other sources, apart from XPlay, so long as these are legitimate, genuine, brand-new, original games, that are and always have been the hallmark of our product offerings to our customers.

DataBlitz has been in the gaming industry for over 17 years now, and our record speaks for itself, we have always maintained a pristine reputation as the one reliable source for original and genuine games at reasonable prices. From the very beginning when piracy dominated the market 17 years ago and up to this day that we have been able to steadily educate our consumers (without harassing anyone) about buying and patronizing original games and software, we have remained steadfast in our core belief of looking after the welfare of the gaming public first and foremost.

If there suddenly are now parties out there who see the vibrancy of the gaming industry as a way to profit immensely by using sham claims of being the only party that possesses "authorized" stocks (whatever that means) in order to shove overpriced games down the throats of the gaming public, this kind of modus is just against the core principles of DataBlitz and something we just cannot and will not go along with.

At the end of the day, we have the welfare of our customers at heart, not the twisted desires of these opportunists. Even if it means this will be a lonely battle, as Monday's events have shown that we were very obviously the only one unjustly and unreasonably singled out, we shall always remain as the one beacon of light and hope for gamers everywhere and carry on the good fight to stop such forms of profiteering through harassment.

It is unfortunate that businesses had to be disrupted by the incident that transpired yesterday. While we sympathize with other individuals dragged on by this issue, we stand by our ground to be vigilant in dealin

This is not a knee-jerk reaction from X-Play. In fact, meetings were held with Datablitz President, Winston Lim and his team to become X-Play's primary partner for NBA 2K13. Datablitz key executives Sandra Lu and Orpha Oambas even participated in X-Play's distributor conferences and got all the marketing and distribution plans of the company.

Datablitz's decision to acquire and distribute NBA 2K13 through unauthorized means despite these efforts, leaves X-Play no other option but to report this to the proper authorities, in which CIDG and the Regional Trail Court took immediate action on.

The action of Datablitz was not only detrimental to X-Play but also affected other smaller retailers, game stores and entrepreneurs.
We hope nothing more but to resolve this predicament but will hold firm in protecting the industry from smugglers and illegal operators."

n a surprising news update, it was reported that the Robinson’s Ermita branch of Datablitz was raided by the PNP because it was reported to be selling “pirated” software.

In the GMA news article, it was said that the PNP acted on a complaint by X-Play Online Games Inc. Distributor of NBA 2k13 among other game titles. However, in a different news from bombo radyo other branches of Datablitz were hit as well. Back2Gaming tried to contact Datablitz about the matter and it was indirectly expressed that it was both the Ermita branch and the V-Mall branch that was hit by the PNP raid.

This bit of news has spread like wildfire within the communities and patrons of the game retailer called it as “absurd” since Datablitz has never been reputed to sell pirated copies of games or software. In fact, Datablitz has been known to be one the “go-to” stores for any legit copy of any game.

Police on Monday raided a gaming and multimedia store in a popular Manila mall for allegedly selling pirated gaming software.

The Philippine National Police's Criminal Investigation and Detection Group seized what were described as "fake" software in the raid, radio dzBB's Cecilia Villarosa reported.

Raided was the branch of Datablitz at the Robinsons Ermita mall, based on a complaint by X-Play Online Games Inc.

X-Play is the distributor of NBA 2K13 and other entertainment software products, the report said.

The complaint prompted the Makati Regional Trial Court Branch 24 to issue the search warrant.

Kadami kayang nagkalat sa quiapo (echiage or something) na pekeng xbox wii ps2 games. Bat hindi un ang hulihin nila e andon ang biggest catch of them pokemon all. Sheeeshhh... Common sense, gone. Way to go gents.

bakit branch kasi ang ni-rade and hindi yung warehouse nila sa recto? kasi doon baka possible na nagpapakawala sila ng orig na copy para ipakopya sa mga pirata.. pero i doubt it din kasi mas nauuna pa din sa ibang bansa makapag labas ng mga pirated games.. malabo na mag benta ang DB ng mga pirated games lalo na NBA 2K13.. :facepalm:

MANILA, Philippines -- Illegally sourced software products worth P2.65 million were seized by the Philippine National Police's Criminal Investigation and Detection Group (CIDG) from several outlets in Metro Manila of a major gaming and software store.

Police conducted raids in DataBlitz outlets based on a complaint filed against the store by X-Play Online Games, Inc., a local distributor of computer gaming software and operator of online multiplayer games.

"This stemmed from the complaint lodged by the head of security of IPE-G, the owner of X-Play," CIDG spokesperson Sr. Insp. Kim Gonzales toild InterAksyon.com in a phone interview Monday night.

X-Play, a joint venture between IP E-Games Inc. and GMA New Media, Inc., is the exclusive distributor of Blizzard and NBA computer gaming titles in the Philippines.

Eleven search warrants against DataBlitz were issued by the courts, which "were applied last October 31," according to Gonzales.

The DataBlitz branches raided by the police are located in Megamall, Market! Market!, Robinson's Galleria, Rockwell Power Plant, Greenbelt, Expo Exchange, Virra Mall Greenhills, and Robinson's Magnolia, among other outlets.

The software products in question include the recently released NBA 2K13 game, which is exclusively distributed locally by X-Play. DataBlitz has reportedly not been appointed by X-Play as a reseller for the said game title.

Other gaming titles were also reportedly seized by the police, but Gonzales was not able to identify which specific titles they were.

Contrary to earlier reports by some news outlets, the pieces of software seized from DataBlitz were neither counterfeit nor pirated, but were just sold without proper authorization from the local distributor, according to the CIDG official.

Gonzales said DataBlitz would be charged with violation of Section 168 of Republic Act 8293, or the law on unfair competition.

X-Play and DataBlitz could not be immediately reached for comment as of posting time.

DataBlitz, a 100-store retail chain of gaming software and other entertainment products, is just one of the very few remaining stores in the Philippines where gamers and enthusiasts can order legitimate copies of their favorite computer games.

Recently, DataBlitz became a venue for local pre-orders of popular gaming titles such as Blizzard's Diablo III and World of Warcraft.

Eto update mga sir, grabe, bat ganun? sampal ito sa datablitz, turns out hindi piracy ang kaso. Nagmukha raw na parang hindi legal na distributor ang Datablitz ng NBA 2k13, ngayon ko lang nalaman na X-play pala ang distributor ng NBA 2k13 dito sa Pinas. Hay nako. Kawawa naman ang Datablitz kung kakasuhan sila ng ganito.

Jealousy is all I can say....

That and they want no competition at all in selling the game/games...

Have always been a fan of Datablitz and how they conduct business.
If anything, the authorities should go after the underground/black market of illegal games and distributors
instead of the squeaky clean honest to goodness Datablitz gaming chain.

Some companies stoop so low, and do not think how the local gaming community would react to such a cause...
It should only bring unwanted negativity onto X-Play.

man, I don't even know why X-Play is so outrageous about this thing. Their are too many distributors of pirated games from A to B but they don't even bother investing on doing some investigations about it. I hope Datablitz would make a big move on this issue.
